Purchase Terms and Conditions

These Purchase Terms and Conditions govern purchases made through OOA Gallery and define the respective rights and obligations of OOA Gallery and its customers in relation to the sale of artworks, payment, shipping, returns and related services.

By placing an order through ooagallery.com, the customer acknowledges that they have read, understood and accepted these Purchase Terms and Conditions in full.

Prices, Taxes and Import Duties

Prices for artworks are displayed in euros and, unless otherwise stated, do not include shipping costs, customs duties, import taxes or any local taxes that may apply in the country of delivery.

For orders delivered outside Spain, the customer is considered the importer of the artwork. The artwork will be shipped with the relevant invoice and, where applicable, customs documentation. Customs duties, import taxes, local taxes or administrative fees may be payable according to the laws and regulations of the destination country.

These duties, taxes and fees are not the responsibility of OOA Gallery and remain the sole responsibility of the customer. We recommend that customers contact their local customs or tax authorities before placing an order for further information.

OOA Gallery reserves the right to modify prices at any time without prior notice. Artworks will be invoiced according to the price confirmed at the time of order, subject to availability and correction of any typographical or technical error.

Orders and Order Confirmation

Orders may be placed through ooagallery.com or through direct communication with OOA Gallery. When confirming an order, the customer accepts the artwork, the price, the applicable shipping arrangements and these Purchase Terms and Conditions.

The information recorded by ooagallery.com constitutes proof of the transactions made between OOA Gallery and its customers. The information recorded by the payment provider constitutes proof of the financial transaction.

Orders are subject to artwork availability. OOA Gallery reserves the right to decline or cancel an order in the event of unavailability, pricing error, payment issue, technical error or any other legitimate reason.

Once an order has been confirmed, cancellation is subject to the agreement of OOA Gallery, without prejudice to any rights that may apply under applicable law.

Payment

Payment may be made by bank transfer or by credit card through Stripe, unless another payment method has been expressly agreed in writing with OOA Gallery.

Orders are processed only after OOA Gallery has received full payment of the invoiced amount. Ownership of the artwork is transferred only after full payment has been received.

OOA Gallery does not store the customer’s credit card details. Payments by credit card are processed securely through Stripe.

Shipping and Delivery

Artworks are delivered to the shipping address provided by the customer during the ordering process. The customer is responsible for ensuring that the delivery information is accurate and complete.

Shipping costs vary depending on the size, weight, value and destination of the artwork. Unless shipping costs are already included in the order confirmation, they will be calculated after the order has been processed and communicated to the customer before shipment.

OOA Gallery takes care to arrange professional packaging and appropriate shipping for artworks. The average processing time after receipt of full payment is approximately 72 hours, unless otherwise stated. Estimated shipping times may vary depending on the destination, carrier, customs procedures and external circumstances beyond the control of OOA Gallery.

When available, a tracking number will be provided to the customer. The customer may use this tracking number to follow the delivery progress on the carrier’s website.

Any unusual delay will be communicated to the customer by email where possible.

Returns and Refunds

Subject to the conditions set out below and to any applicable legal provisions, the customer may request a return within 15 days from the date of receipt of the artwork.

Return shipping costs, insurance costs, customs duties, import taxes, local taxes and any administrative fees related to the return are the responsibility of the customer, unless otherwise required by applicable law or expressly agreed in writing by OOA Gallery.

Refunds will only be accepted if all the following conditions are met:

  • The return request is made within 15 days from the date of receipt of the artwork.
  • The artwork is returned complete, undamaged, unsoiled and in perfect condition.
  • The artwork is returned in its original packaging or in packaging offering an equivalent level of protection.
  • The artwork is shipped with appropriate tracking and insurance.

OOA Gallery reserves the right to refuse a refund if the returned artwork is damaged, incomplete, soiled, altered or not packaged with adequate protection.

Once the returned artwork has been received and inspected by OOA Gallery, any approved refund will be issued using the original payment method where possible, or by bank transfer to the customer who placed the order. Refunds cover the price of the artwork only, unless otherwise required by applicable law or expressly agreed in writing.

Complaints and Damaged Works

The customer must inspect the artwork upon delivery. Any complaint concerning damage, defects, missing items, inaccurate quantities or incorrect references must be made in writing to OOA Gallery within 5 working days from receipt of the artwork.

Complaints should be sent by email to sorella@ooagallery.com and should include the order details, a description of the issue and clear photographs of the artwork, packaging and any visible damage.

If no written complaint is received within this period, the artwork will be deemed to have been accepted by the customer, without prejudice to any rights that may apply under applicable law.

Privacy

OOA Gallery processes personal data in accordance with its Privacy Policy and applicable data protection regulations.

Customers who provide personal data through ooagallery.com or through direct communication with OOA Gallery authorize OOA Gallery to use such data for the purposes of processing orders, arranging payment, organizing shipping, managing customer communication and complying with legal obligations.

Customers may exercise their rights of access, rectification and deletion of personal data in accordance with applicable regulations and the procedures described in the Privacy Policy.

Applicable Law and Jurisdiction

These Purchase Terms and Conditions are governed by Spanish law.

OOA Gallery shall not be held responsible for any non-compliance of an artwork with laws, regulations or administrative requirements applicable outside Spain. Customers purchasing from another country are responsible for ensuring that the artwork may be lawfully imported into their country of delivery.

In the event of a dispute relating to the interpretation, performance or termination of these Purchase Terms and Conditions, the parties will first seek to resolve the matter amicably. If no amicable solution can be reached, the dispute shall be submitted to the competent Spanish courts, subject to any mandatory legal provisions that may apply.
